Phillips Home Improvements Polyaspartic Garage Floor Coating Warranty
Workmanship
This warranty is limited to workmanship and only applies to the original customer.
Inclusions – What is covered
- Your new polyaspartic garage floor coating is covered against peeling, or chipping as a result of improper surface preparation or application for a period of fifteen (15) years, as long as you, the original purchaser, own the home.
Exclusions – What is not covered
- Damage to the coating due to reasons other than a defect in workmanship. Examples include, but are not limited to: heavy impact, gouging, scratching, or scraping from equipment or furniture.
- Damage from “hot tire pickup,” although our coatings are highly resistant.
- Staining from chemicals, oils, rust, or other substances that are not cleaned in a timely manner.
- Damage or failure caused by issues with the underlying concrete substrate, such as cracking, shifting, settling, or hydrostatic pressure (moisture vapor transmission from beneath the slab).
- Fading or color change due to direct UV exposure.
- Normal wear and tear, including loss of gloss over time.
- Abnormal use, misuse, alterations, abuse, vandalism, or negligence.
- Damage or defects caused in whole or in part by reason of fire, explosion, flood, acts of God, extreme weather conditions, or any other similar causes beyond the control of PHILLIPS.
- Damage to surrounding walls, structures, or personal property within the garage.
Materials
- The materials applied by Phillips are guaranteed by the manufacturer and not by Phillips. In the unlikely event of a material defect, we will assist you in getting the issue resolved with the manufacturer.
Remedy – What Phillips is obligated to do about a covered problem
- If a defect in workmanship appears and is reported to Phillips in writing within the Warranty Period, Phillips will inspect the affected areas.
- The sole remedy against Phillips under this limited warranty shall be for repairing or replacing, at our discretion, the specific defective area of the coating. This does not include any consequential damages to the substrate, personal property, or anything else. We also reserve the right to provide a partial or full refund in lieu of repair or replacement..
Transferability
- If the original customer sells the property, this warranty may be transferred to the new owner at no charge, provided that the transfer request is submitted to Phillips in writing within 12 months of the project completion date.
Eligibility
- This warranty only applies to work that has been paid in full and on time in accordance with the original contract terms.
- Property must be accessible to Phillips to perform inspections and any necessary repairs.
Additional Details
THIS LIMITED WARRANTY IS THE ONLY WARRANTY MADE BY PHILLIPS AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED. THIS WARRANTY COVERS ONLY THOSE SERVICES PROVIDED BY PHILLIPS TO THE ORIGINAL PURCHASER NAMED ON THE FRONT OF THE CONTRACT. IN NO EVENT SHALL PHILLIPS BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR DAMAGES IN EXCESS OF THE ORIGINAL CONTRACT PRICE. THIS WARRANTY MAY NOT BE ALTERED OR EXTENDED FOR ANY PURPOSE UNLESS DONE SO IN WRITING IN A DOCUMENT EXECUTED BY ALL PARTIES TO THIS CONTRACT.
